What should forum policy be on defamatory posts?

They are two separate issues. 

1. Should people be banned for having certain thoughts or beliefs even if they follow the posting rules of the forum.
2. Should people be banned for being proven guilty of specific crimes even if they follow the posting rules of the forum.

I'm not not sure that in either case someone should be banned.

France has rape laws that takes into account child consent. It looks like it’s not working.

Question 1.  Yes (for certain beliefs)

Question 2. It depends what the crime was and if they have expressed regret and a desire not to do it again.
